LEGAL DOCUMENTS TO PERFORM A CIVIL MARRIAGE FOR:

A SOUTH AFRICAN CITIZEN TO A FOREIGNER


IMPORTANT INFORMATION: WHEN A SOUTH AFRICAN CITIZEN MARRIES A NON-SOUTH AFRICAN CITIZEN THEY HAVE TO GO FOR AN INTERVIEW AT THE DEPARTMENT OF HOME AFFAIRS IN THE AREA WHERE THE MARRIAGE OFFICER IS REGISTERED.


The marriage officer requires the following legal documents to perform a legal marriage:

From the South African Citizen:

    • Three  colored identity document size photos of the bride and bridegroom each
    • Two (2) clear uncertified copies of the bride/bridegroom’s identity documents each. (ORIGINAL IDENTITY DOCUMENT TO BE PROVIDED ON DATE OF MARRIAGE TO CONFIRM CERTIFIED COPIES)

From the Non-South African Citizen:

    • Three  colored identity document size photos of the bride and bridegroom each
    • Two (2) clear uncertified copies of the bride/bridegroom’s legal passport (ORIGINAL LEGAL PASSPORT TO BE PROVIDED ON DATE OF MARRIAGE TO CONFIRM CERTIFIED COPIES)
    • Two (2) clear copies of valid visa or proof of last entry stamp in the passport
    • Two (2) clear English translated copies of a letter of no impediment from the country of origin

From Both South African & Non-South African Citizens:

    • Proof of residential address is required (No postal address is acceptable)
    • If getting married out of community of property, an ANC in English from the attorney on a proper letterhead signed and stamped by the attorney will be required
    • Two (2) witnesses are required for the signing of the marriage register (One on each side of the Bride and the Bridegroom)
    • The witnesses MUST be South African Citizens and older than 18 years
    • Two(2) clear uncertified copies of identity documents of both witnesses are required (ORIGINAL IDENTITY DOCUMENTS HAS TO BE PROVIDED ON DAY OF THE MARRIAGE)

IMPORTANT INFORMATION TO NOTE:

    • A temporary identity document is acceptable but should not be older than 3 MONTHS
    • South African/ Non-South African Citizens: NO birth certificates is at all acceptable
    • If you were previously married  and now divorced we require 2 clear English translated copies of the FINAL DECREE OF DIVORCE signed and stamped by the COURT (NO SUMMONS OR SETTLEMENT AGREEMENT WILL BE ACCEPTED)
    • South African/ Non-South African Citizens: If you were previously married and your spouse is deceased, 2 clear English translated copies of the death certificate will be required (ORIGINAL DEATH CERTIFICATE MUST BE PROVIDED)
    • South African/Non-South African Citizen: The couple will on the day of the marriage receive the original DH30 (marriage register) and also the DH27 (handwritten marriage certificate)
    • It is the responsibility of the marriage officer to have the marriage registered within 3 DAYS after the Marriage was performed at the DEPARTMENT OF HOME AFFAIRS
