LEGAL DOCUMENTS TO PERFORM A CIVIL UNION SAME-SEX MARRIAGE FOR NON-SOUTH AFRICAN CITIZENS


IMPORTANT INFORMATION: WHEN BOTH PARTIES ARE NON-SOUTH AFRICAN CITIZENS GETTING MARRIED IN SOUTH AFRICAN THERE IS NO NEED TO GO FOR AN INTERVIEW AT THE DEPARTMENT OF HOME AFFAIRS.


The marriage officer requires the following legal documents to perform a legal marriage:

FROM BOTH PARTIES:

    • Three (3) colored identity document size photos of both the brides and bridegroom.
    • Two (2) clear uncertified  copies of brides/bridegrooms’ identity documents (ORIGINAL IDENTITY DOCUMENT TO BE PROVIDED ON DATE OF MARRIAGE TO CONFIRM CERTIFIED COPIES) 
    •  Two (2) clear uncertified copies of brides/bridegrooms’ legal passport (ORIGINAL LEGAL PASSPORT TO BE PROVIDED ON DATE OF MARRIAGE TO CONFIRM CERTIFIED COPIES)
    • Two (2) clear copies of valid visa or proof of last entry stamp in the passport
    • Two (2) clear English translated copies of the letter of no impediment from the country of origin
    • Proof of English translated residential address is required (No postal address is acceptable)
    • Two (2) witnesses are required for the signing of the marriage register (One on each side of the Brides and the Bridegrooms)

IMPORTANT THINGS TO NOTE

    • NO birth certificates are at all acceptable
    • If getting married out of community of property, an ANC in English from the attorney on a proper letterhead signed and stamped by the attorney will be required
    • If you were previously married and now divorced, we require 2 clear English translated copies of the FINAL DECREE OF DIVORCE signed and stamped by the COURT (NO SUMMONS OR SETTLEMENT AGREEMENT WILL BE ACCEPTED)
    • If you were previously married and your spouse is deceased, 2 clear English translated copies of the death certificate will be required (ORIGINAL DEATH CERTIFICATE MUST BE PROVIDED)
    • The witnesses MUST be South African or Non-South African Citizens and older than 18 years. If South African citizens Two (2) clear copies of their identity documents and if Non-South African Two (2) clear copies of the passport, visa, or last entry stamp.
      • ORIGINAL IDENTITY DOCUMENTS HAS TO BE PROVIDED ON DAY OF THE MARRIAGE
    • The couple will on the day of the marriage receive the original DH1766 (marriage register) and also the DH1765 (handwritten marriage certificate)
    • It is the responsibility of the marriage officer to have the marriage registered within 3 DAYS after the Marriage was performed at the DEPARTMENT OF HOME AFFAIRS
